Your Estate Plan is by definition a carefully considered arrangement for the management and disposition of your financial and medical affairs in the event of your incapacity during your lifetime and your personal property upon your death.

Document:  Last Will & Testament

 
What It Does: Your Last Will & Testament  names your personal Representative (the person that acts as you would if you were still alive) and it also names the Guardian of your minor children.  A Last Will & Testament also is how one often passes on personal property to ones Heirs.
 
Why You Need It: Without a Will, the laws of your state will dictate who receives your assets even though you may want something different done with them.
 
What To Keep In Mind: An attorney can help you prepare a Will that distributes your assets in the manner you choose.

Document:  Living Will

 
What It Does: Your  Living Will specifies what you want or don't want for medical treatment if you are unable to express those wishes.
 
Why You Need It: A Living Will is a document that allows you to control the type and the treatment options which you will receive if you are in a persistent vegetative state.
 
What To Keep In Mind: As long as you are mentally competent and able to express your wishes, your instructions will control.

Document:  Financial Power of Attorney (Durable)

 
What It Does: This document names a person to make financial decision for you if you are unable to make them yourself.
 
Why You Need It: A Durable Power of Attorney will avoid the cost, time and hassle of having someone go to Court to be appointed as your guardian.
 
What To Keep In Mind: As long as your mentally competent, you can appoint, revoke or change the power of attorney.

What It Does: A HIPAA authorization is a document that empowers someone you trust to have access to your Medical Records when necessary to make important decisions for you, when you are unable to make them for yourself.
 
Why You Need It: If you have empowered someone to make decisions for you they will need the most accurate medical information in order to make the best informed decisions.

Document:  Beneficiary Deed

 
What It Does: A Beneficiary Deed specifies to whom a person's principal residence will pass upon death.
 
Why You Need It: An Arizona Beneficiary Deed avoids the cost and delay of probate because the property is not part of the probate estate of the deceased owner.  Avoiding probate can save a family $1,500 to $3,000 or more in legal fees.
 
What To Keep In Mind: The owner may revoke an Arizona Beneficiary Deed at any time by recording an appropriate revocation with the county recorder of the county in which the property is located.
